3a. Work-seekers: fees, terms and pay
We act as an employment business supplying temporary workers, and we tell every work-seeker and every hirer whether we are acting as an employment business or as an employment agency before we provide services to them. We do not charge a work-seeker any fee for finding, or seeking to find, them work. Charging such a fee is prohibited by the Employment Agencies Act 1973 and the Conduct of Employment Agencies and Employment Businesses Regulations 2003. We do not make the provision of work-finding services conditional on a work-seeker using, or paying for, any other service, training, equipment, accommodation or product supplied by us or by any person connected with us.
Before we provide work-finding services, a work-seeker is given written terms setting out whether they are engaged under a contract of service or a contract for services, the notice required on each side, the rate of pay, the intervals at which it is paid and the entitlement to annual leave and holiday pay. Before an assignment begins we give the details of the position, the location, the hours, the start date, its likely duration, the rate and any risks known to us. We pay for hours actually worked and we do not withhold payment because a timesheet has not been signed by the hirer; where a hirer disputes hours we investigate and pay what is due. After twelve continuous calendar weeks in the same role with the same hirer, agency workers are entitled under the Agency Workers Regulations 2010 to the same basic working and employment conditions as a comparable directly recruited worker, and we apply that entitlement.
3b. Hirers, checks and limits
Hirers are given written terms before we supply any worker. We carry out the right to work checks required by law and obtain the information and, where the position requires it, the qualifications, references and authorisations that the Conduct Regulations require, including the additional steps that apply where a position involves working with children or vulnerable adults. We will not supply a worker where we are not satisfied that those requirements are met. The hirer remains responsible for health and safety at the place of work, for supervision and for its own statutory duties. We do not supply workers into any sector requiring a licence from the Gangmasters and Labour Abuse Authority unless we hold the relevant licence. We give no legal, tax, immigration or employment-law advice, and nothing on this website is advice for your particular situation.
4. Liability
Nothing in these terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by negligence, or for fraud. Subject to that, our liability in connection with this website is limited to the fullest extent permitted by law.
5. Privacy
We process personal data in accordance with our Privacy Policy.
6. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
7. Changes
We may update these Terms from time to time. The version published at the time of your visit applies.
